Terms of Service
These Terms govern access to and use of ARTARA (the "Platform"), including the website, mobile applications, and any related services, tools, or features offered in connection with the sale and purchase of artworks.
Key Principles
- The Platform provides an online marketplace that connects artists and other sellers with collectors. The Platform does not act as the buyer of artworks, unless expressly stated in specific programmes.
- Users must be at least eighteen (18) years old and have the legal capacity under applicable law in the UAE to enter into binding agreements.
- By creating an account or using the Platform, users agree to comply with the Terms of Service, any applicable policies referenced therein, and all applicable laws and regulations of the United Arab Emirates.
- All content, references, visuals etc. on this platform and website are used purely for illustration. They remain the property of their respective owners where applicable.
- By referring and using this platform and website, the user hereby indemnifies the platform and its promoters of all claims and confirms to using the platform at their own discretion.
User Accounts
- Users must provide accurate, current, and complete information when registering an account and must keep this information up to date.
- Users are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account.
- The Platform reserves the right to suspend or terminate accounts where there is a breach of the Terms of Service, suspected fraud, abuse, or other improper activity.
Marketplace Role
- The Platform facilitates introductions and transactions between artists or sellers and collectors. Unless expressly stated otherwise, the Platform is not a party to the sale contract between the artist and the collector.
- Prices, availability, and descriptions of artworks are primarily provided by artists or sellers. While the Platform may assist in curating content, it does not guarantee that all information is error-free or complete.
Fees and Commissions
- The Platform may charge commissions, listing fees, or other service charges on successful sales. The specific fee structure applicable to artists will be outlined in the artist onboarding materials and may be updated from time to time.
- Any applicable fees will typically be deducted from proceeds payable to the artist or otherwise charged as disclosed in advance.
Prohibited Uses
- Users may not use the Platform for any unlawful purpose, including activities that would violate UAE laws relating to content, privacy, cybercrime, intellectual property, or financial services.
- Users may not upload content that is defamatory, obscene, discriminatory, offensive, or otherwise contrary to public morals and order as understood under UAE law.
- The Platform may remove content or suspend access where it reasonably believes that content or user behaviour violates these guidelines.
Governing Law
- ARTARA is a website and platform owned by Concept Marketing and Coaching FZE licensed by Sharjah Publishing City - Free Zone Authority in the UAE.
- The Terms of Service and any disputes arising out of or relating to use of the Platform are governed by the laws of the United Arab Emirates, without reference to conflict of law principles.
- Subject to any mandatory dispute resolution mechanisms provided under applicable law, the courts of the relevant Emirate in which the Platform's operating entity is established will have non-exclusive jurisdiction over such disputes.
